Drivemycamper Limited Vehicle Rental Agreement and Terms and Conditions

Please be advised that if you do not adhere to the Terms & Conditions regarding Driver Age, Payment, Driving Licences & History, Identification Required and Rental Payment Terms when collecting the Vehicle, our Cancellation Policy will apply.

1. Definitions of Terms and Conditions
1.1. 'You', 'I','me' and 'my' refers jointly and severally to the person or persons who are the Customers.
1.2. ‘This Agreement' means the Rental Agreement, the Insurance Motor Rental Agreement and these Terms and Conditions. In the event of any discrepancy between these Terms and Conditions and any other Drivemycamper literature, the provisions of these Terms and Conditions will apply.
1.3. ‘Customer’ means the person or persons nominated as the hirer(s) under the heading 'Hire Details' on the Insurance Motor Rental Agreement.
1.4. 'Living Equipment' includes but is not limited to DVD player, CD player, crockery, cutlery, cooking utensils, towels, extension cables and fan heater.
1.5. 'Rental Period' means the hire period referred to under the heading 'Booking Details' on the Rental Agreement or any agreed variation thereof and any additional period during which the vehicle is in the customer's possession or control.
1.6. 'Vehicle' means the vehicle described under the heading 'Vehicle Details' on the Rental Agreement and includes tyres, tools, accessories, the Living Equipment and any other special equipment, documents related to the Vehicle and any replacement or substitute Vehicle which may be provided at the discretion of DMC.
1.7. 'Security Deposit' means the Vehicle security deposit (normally £500).
1.8. ‘DMC’ means Drivemycamper Limited.

2. Driving Licence & Driver History - Drivers are subject to approval by our insurance provider’s requirements. A GUIDE is as follows:
2.1. You must provide us with details of all drivers of the vehicle. There is a maximum of 3 drivers permitted per Vehicle. More than one driver is charged at £5.00 per day for each extra driver.
2.2. All drivers must be aged between 21 and 70. The hire charges we state includes UK insurance for one named driver, aged 25-70 with no convictions or endorsements on their licence. An additional daily charge of £10.00 applies to drivers aged 21-24.
2.3. Drivers aged 25-69 must hold a full driving licence for a minimum of 12 months. Drivers aged 21-24 must hold a full driving licence for a minimum of 24 months which is free of endorsements.
2.4. EVERY Driver must present both parts of a valid driving licence with their current address in person, at the time of collection. No copies of licences will be accepted.
2.5. Licence endorsements up to 9 points may be accepted. If the Driver has been banned from driving for a DD, DR or UT offence, or has been disqualified for 12 months or more, DMC’s insurers will only consider renting 5 years or more after the return of the licence.
2.6. DMC cannot hire to any person who has been convicted of a major conviction during the past five years or has any such prosecution pending.
2.7. DMC cannot hire to any persons who have had a policy cancelled or a proposal declined or a renewal refused by an insurer.
2.8. DMC cannot rent to the following: Market traders, second hand clothes dealers, scrap merchants, vehicle dismantlers or breakers, professional gamblers, professional sportspeople, entertainment professions inc parttime, armed forces of non UK countries, students and unemployed persons.
2.9. DMC cannot hire to any person who has been involved in 2 or more accidents in the proceeding three years.
2.10. DMC may accept foreign licence holders as long as such persons are aged over 25 years and have held a full licence for a minimum of 2 years. An additional £10.00 per day surcharge will apply.

3. Identification – when collecting the Vehicle EACH DRIVER MUST present the following:
3.1. A valid driving licence (BOTH PARTS of the UK Licence are required);
3.2. One additional form of ID to confirm home address as shown on driving licence (eg. utilities bill, bank statement which must have been issued to the Driver within 2 months of date of hire); and
3.3. If you are not leaving your vehicle with us then we will also need to retain one Driver’s Passport.

Each Driver must provide BOTH parts of their driving licence - we need to see the original of both the paper and card part of the licence. In addition, we need a utility bill less than two months old verifying each Driver’s driving licence address. The £500 Security Deposit MUST be paid prior to collection. THESE ITEMS ARE ESSENTIAL. Without them, we will not be able to release the Vehicle and no refund will be made.

4. Insurance & Damage
4.1. Standard excess - the quoted rate includes a standard excess of GB£750. In the event of a road accident resulting in any damage to either the vehicle or third party property, the Customer will be liable for the first GB£750. This can be reduced to £250 on payment of a £16.00 per day waiver. The waiver will be deducted from the Security Deposit when you return the Vehicle.
4.2. The insurance covers the Vehicle to carry a maximum of four people.
4.3. The Customer will also be fully liable for replacement or repair of windscreen or tyre damage. If the Vehicle is stolen and the keys cannot be found by the Customer, then the Customer is responsible for the replacement cost of the Vehicle. The Customer agrees that he will remove the keys when he vacates the Vehicle and ensure the vehicle is left securely.
4.4. You will be liable for any costs associated with the incorrect use of fuel for the Vehicle

5. Security Deposit
5.1. You agree to pay a refundable GB£500.00 Security Deposit payable in cash or via PayPal. This must be received by DMC in cleared funds prior to collection of the Vehicle. This payment is fully refundable within 7 days of the return of the Vehicle to the agreed location, on the agreed date and time, in the same condition as it was let out to you, the interior being clean including the Living Equipment and the tank full of petrol. If the Vehicle has not be refilled fully with fuel - a £10.00 service charge will be made in addition to the cost of the fuel. If there is any damage, the cost of repairing any such damage as well as any consequential loss to DMC will be deducted from the Security Deposit. Consequential loss will include but not be limited to loss of rental income if DMC need to cancel any bookings because of damage to the Vehicle. If the costs exceed the Security Deposit, this amount will be payable to DMC on receipt of invoicing from DMC.
5.2. The Security Deposit will be used to fund any loss or damage whatsoever to equipment, fixtures and fittings or negligent damage to the Vehicle.
5.3. You irrevocably authorise DMC to deduct from the Security Deposit any amounts due to DMC arising out of this Agreement.

6. Hire rates quoted include:
6.1. 70 miles per day and then 20p per additional mile;
6.2. UK standard vehicle insurance*; and
6.3. UK breakdown cover.
*Insurance loading. In some cases, DMC will incur additional insurance charges if the proposed driver(s) has a traffic conviction, is using a non-UK driving license, is under 25 years old or is in an occupation which is deemed high risk. You agree to pay for any additional insurance loading charges.

7. Additional Insurance Charges
The additional insurance loading charges set out below ARE FOR GUIDE PURPOSES ONLY:
7.1 More than one driver: (UK only) £5.00 per person per day (subject to clean driving licence).
7.2 Points on licence: £2.50 - £10.00 per day per three points (depending on number & type of points)
7.3 Each previous accident: £10.00 per accident per day for each driver. (Please note that if points are shown on a drivers license, they will be counted for up to 9 years).
7.4 Non UK driver's license holder: £5.00 – 10.00 per day
Driver aged between 21 – 24 years old: £10.00 per day.

8. Business hours
We open by appointment only.
It is ESSENTIAL that you arrive promptly for your collection time. DMC reserves the right to charge for late collections at £10 per 30 minutes, to cover additional staff costs.

9. One way rentals
Not permitted. If the Vehicle is not returned to the collection point FOR ANY REASON a collection charge of £1.30 per mile will be made from the collection point to the Vehicle and back to the collection point. If the Vehicle becomes undrivable AA Relay will offer to transport the Vehicle back to the collection point but the Vehicle must be accompanied by the Customer. Otherwise the mileage charge of £1.30 per mile will apply.

10. Reservations and Payments
10.1. Full payment is due 6 weeks before collection. If full payment has not been made by this time, DMC reserves the right to cancel the booking and has no obligation to make any refund of booking deposit.
10.2. Payment is by PayPal, Visa, Mastercard, Switch.
10.3. Optional extras such as Satellite Navigation & Awnings can be booked. However these are subject to availability and if not available any booking fee for these items will be refunded.
10.4. You will pay DMC:
10.4.1. all rental charges;
10.4.2. the Security Deposit;
10.4.3. the nominated valeting fee of up to £100 if the Vehicle is not returned with the interior in a clean condition;
10.4.4. the nominated cancellation fee in the event of cancellation of this Agreement prior to the hire;
10.4.5. the cost of any damage to the Vehicle or the property of any third party, subject to the insurance cover;
10.4.6. any excess miles at 20p per mile (ie mileage above 70 miles per day);
10.4.7. the Collision Damage Waiver fee, if applicable;
10.4.8. all Government fees and duties etc;
10.4.9. all parking fines, other fines or penalties, and/or accidents including third party property damage not reported on return of the Vehicle, and associated administration costs incurred in relation to the Vehicle during the Rental Period;
10.4.10. any other fees or charges payable pursuant to this Agreement. This includes any costs incurred by DMC as a result of any breach by me of the terms of this Agreement;
10.4.11. the daily rental rate for the period the Vehicle is off fleet for accident repairs (demurrage);
10.4.12. the cost to recover a Vehicle which has become bogged; and
10.4.13. any shortfall in charges to DMC and you will receive a refund for any overcharge acknowledged by DMC.
10.5. Total charges as set out therein are not final and subject to a final audit.

11. Cancellation Charges
11.1. More than 6 weeks before: 25% of total hire charge
11.2. Within 6 weeks of rental start date: 100% of total hire charge.
11.3. if you have made a booking, you are deemed to have agreed to comply with these Terms and agreed that you qualify to hire a vehicle. If you do not qualify, our above cancellation terms apply. If in doubt, please call us.

12. Collection & Return
12.1. Collection: Please see your booking confirmation for details of collection times. If you are going to be in excess of 30 minutes late - it is important that you call our offices so that we can make sure we have staff available to assist with your vehicle collection. DMC reserves the right to charge for late collections at £10 per 30 minutes to help cover additional staff costs. If we do not recieve a call - we reserve the right to change the collection day. Please allow 1 hour for the hand-over at our offices to complete the documentation and demonstrate your Vehicle to you.
12.2. Return: The vehicle must be returned between 09:00 and 12:00 midday on the day of return. Vehicles must be returned clean and in the same condition as they leave the depot, otherwise a charge will be made.
12.3. Late return: If you will be late returning, DMC must be advised immediately. Failure to advise may result in prosecution for driving whilst uninsured. DMC reserves the right to charge £50 per hour for all late returns.
12.4. Parking: You are welcome to leave your car at our premises. However you agree that DMC will accept no responsibility or liability if the vehicle is stolen or damaged.

13. Restrictions
13.1. You agree that during the rental period, you will not allow the Vehicle to be:
13.1.1. driven otherwise than in a cautious, prudent and normal manner;
13.1.2. used in a manner which could cause damage - including driving whilst any warning light operational;
13.1.3. driven on anything other than sealed / bitumen roads;
13.1.4. taken off the mainland UK (eg travel on ferries, to Europe or to Ireland is prohibited);
13.1.5. driven in a prohibited area or in an area other than the areas permitted by under the terms of this Agreement;
13.1.6. driven by a person under the influence of alcohol or drugs or with a blood alcohol level in excess of that permitted by law;
13.1.7. left with the ignition key in the vehicle whilst it is unoccupied;
13.1.8. left unoccupied with the CD faceplate intact;
13.1.9. driven by any persons other than those authorised by DMC and set out under the heading 'Driver Details' in the Motor Rental Agreement;
13.1.10. damaged by submersion in water;
13.1.11. used for any illegal purpose or for any race, rally or contest;
13.1.12. used to tow any vehicle or trailer;
13.1.13. used to carry passengers or property for hire or reward;
13.1.14. used to carry more than 4 persons in total (inc. driver);
13.1.15. used to carry volatile liquids, gases, explosives or other corrosive or inflammable material otherwise used in breach of the obligations under this Agreement; or
13.1.16. used to transport or house any animals (including pets).

14. Breakdown
14.1. You acknowledge that these are vintage vehicles and as such can malfunction unexpectedly. You agree that no refunds will be made in these circumstances other than a refund for the unused full days of rental once the Vehicle has been returned to the collection point.
14.2. You shall take all reasonable steps to properly maintain the Vehicle, including oil checks every day.
14.3. DMC will reimburse you for expenditure reasonably incurred in rectifying any mechanical failure to the Vehicle (not including the water system, refrigerator, heating, audio and DVD equipment ) provided that:
14.3.1. you produce relevant receipts;
14.3.2. you have received the prior written consent of DMC; and
14.3.3. the damage is not due to your negligence, willful misconduct or breach of this Agreement.
14.4. You will be responsible for the cost of repairing or replacing tyres damaged during the Rental Period although DMC will reimburse you for expenditure reasonably incurred if;
14.4.1 you produce relevant receipts;
14.4.2 the tyre is defective and is returned to DMC for inspection; and
14.4.3 the manufacturer accepts liability under its warranty.
14.5 AA Relay breakdown cover is a finite resource and must be treated as such. If you call out the AA unnecessarily (for example, you have allowed the engine battery to run flat or your have flooded the engine) then a flat charge of £100 will be levied and deducted from your deposit.


15. Accidents or Damage
15.1. In the event of any accident, loss or damage arising out of the use of the Vehicle, you will:
15.1.1. notify DMC within 24 hrs of the happening of the event;
15.1.2. obtain the names and addresses of third parties and any witnesses and report the event to the nearest police station;
15.1.3. complete an accident report form;
15.1.4. not make any admission of liability to other parties, settlement offer or other like offer;
15.1.5. procure that any writ of summons, summons or other document relating to any proceeding arising out of such accident is forthwith delivered to DMC at its registered office; and
15.1.6. assist DMC and its insurers in handling any claim arising from any event, including without prejudice to the generality of the foregoing permitting proceedings to be brought by DMC in the name of the Customer and defending any proceedings brought against the Customer (including providing all relevant information and attending Court to give evidence).
15.2. You acknowledge that the excess or other amount due by you in respect of any damage arising from an accident, loss or damage is payable at the time of reporting the event and not at the completion of the Rental Period.
15.3. You will pay for any costs relating to the delivery of a change over Vehicle as a result of an accident regardless of which party is at fault.

16. Calor Gas Supply
The Vehicle is supplied with an LPG Calor gas bottle which fuels the stove and the fridge - this is included within the hire charge. If you should run out please replace the bottle at a petrol station, camping shop or Calor Gas centre and DMC will reimburse you the cost on your return (subject to a maximum aggregate value of £30.00).
NB – If your Calor gas bottle does need replacing it is essential that you replace the Calor Gas bottle in the Vehicle with a “like-for-like” replacement or you will be charged £60.00 in order to replace it on your return.

17. Termination of Agreement
17.1. You acknowledge that DMC may terminate this Agreement and repossess the Vehicle at any time, without notification to you, and that you will pay the reasonable costs of repossessing the Vehicle, including towing charges if;
17.1.1. you are in breach of any term of this Agreement;
17.1.2. you have obtained the Vehicle through fraud or misrepresentation;
17.1.3. the Vehicle appears to be abandoned;
17.1.4. the Vehicle is not returned on the agreed return date or DMC reasonably believes that the Vehicle will not be returned on the agreed return date; or
17.1.5. DMC considers on reasonable grounds, that the safety of passengers or the condition of the Vehicle is endangered. You understand that in the event of such termination or repossession, you have no right to a refund of any part of the rental charges or the Security Deposit.
18. DMC reserves the right, at its absolute discretion, to substitute a comparable or superior Vehicle for the Vehicle. In that event, you shall not be liable for any increased rental or other charges save for any addition running costs pertaining to the substitute vehicle. Such substitution shall not entitle you to any refund and does not constitute a breach of this Agreement. In the event of breakdown or the booked vehicle becoming unavailable and if a substitute vehicle is not available then DMC will refund the cost of the hire on a daily pro rata basis. You agree that you indemnify DMC against any consequential loss incurred by you, if for some reason DMC has to cancel my booking or cannot provide a substitute vehicle.

19. Subject to its obligation to deliver the Vehicle or an appropriate substitute vehicle, you release DMC, its employees and agents, from any liability to you (regardless of who is at fault) for any loss or damage incurred by you by reason of this Agreement, including but not limited to:
19.1. Any loss or damage caused by breakdown, mechanical defect, accident or the Vehicle being unsuitable for my purpose;
19.2. Any loss or damage to any property left in or on the Vehicle, in any service vehicle or on any DMC premises or recovered or handled by DMC;
19.3. Subject to any insurance arrangements agreed with DMC, you hereby indemnify and shall keep indemnified DMC, its employees and agents against any claims, demands and expenses (including legal costs) incurred or sustained by them or any of them by reason of your use and/or possession of the Vehicle.

20. You acknowledge that DMC retains title to the Vehicle and that you possess the goods as a mere bailee only. You do not have any right to pledge DMC’s credit in connection with the Vehicle and agree not to do so. You shall not agree, attempt, offer or purport to sell, assign, sublet, lend, pledge, mortgage, let on hire, or otherwise part with or attempt to part with the personal possession of or otherwise deal with the Vehicle.

21. Any changes to this agreement must be in writing and must be signed on behalf of DMC and by you.

22. When the Customer comprises of more than one person, each person is liable jointly and severally for all obligations of the customer pursuant to this Agreement.

23. You warrant that all information supplied by you to DMC in connection with this Agreement and the Vehicle rental is true and accurate.

24. This Agreement shall be governed by and construed in accordance with the laws of England. All disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the English Courts.

25. This Agreement constitutes the entire agreement of the parties and there are no other oral undertakings, warranties or agreements between the parties relating to the subject matter of this agreement.
